π²π½ Mexico CDL Records & PSP Reports
Mexico CDL Records β U.S. Violations, PSP Reports & What Employers Should Know
Drivers holding a valid Mexican Federal Commercial Driver License (Licencia Federal de Conductor) may operate commercial motor vehicles in the United States.
However, a Mexico driving record does not work exactly like a U.S. state CDL Motor Vehicle Record (MVR).
β Will U.S. Violations Show on a Mexico Driving Record?
Not necessarily.
A Mexico driving record may not display every:
- U.S. traffic citation
- Roadside inspection violation
- Court conviction
- Commercial driving violation
β οΈ Important:
The absence of a U.S. violation on a Mexico driving record does not necessarily mean the driver has no U.S. driving or safety history.
πΊπΈ How Are U.S. Convictions Handled?
FMCSA maintains a federal system known as the:
Foreign Convictions and Withdrawals Database (FCWD)
Certain qualifying U.S. convictions involving Mexico-licensed commercial drivers may be reported to this federal system.
For example, a U.S. citation that results in a qualifying conviction may be associated with the driver's Mexican Federal license when the driver's:
- Name
- Date of birth
- License jurisdiction
- Mexican Federal license number are properly recorded.
Some convictions may also affect the driver's ability to operate a commercial vehicle in the United States.
π Can Employers Search the FCWD?
No.
The FCWD is not a public employer-search database.
It is primarily available to authorized:
- State agencies
- FMCSA
- Government users
Employers cannot simply perform a free FCWD search on a Mexico CDL driver.
π What Is an FMCSA PSP Report?
The FMCSA Pre-Employment Screening Program (PSP) provides additional U.S. commercial driving safety information.
A PSP report can include:
π 3 Years of Roadside Inspection History
Including violations recorded during roadside inspections.
π₯ 5 Years of FMCSA-Reportable Crash History
Including qualifying commercial vehicle crashes reported to FMCSA.
β οΈ Safety Violations
Examples may include:
- Hours-of-service violations
- Unsafe driving violations
- Driver qualification violations
- Out-of-service violations
- Vehicle safety violations
- Other violations documented during roadside inspections
π²π½ Can PSP Be Ordered for a Mexico CDL Driver?
Yes.
MVRcheck can manually process an FMCSA PSP report for eligible drivers holding a Mexican Federal Commercial Driver License.
This can be especially helpful when the driver has previously operated commercial motor vehicles in the United States.
β οΈ Does PSP Show All U.S. Violations?
No.
A PSP report is not a complete U.S. traffic ticket or court conviction search.
PSP primarily shows violations associated with FMCSA roadside inspections.
Example
β May appear on PSP:
A speeding, hours-of-service, or driver qualification violation recorded during an FMCSA roadside inspection.
β May not appear on PSP:
A speeding ticket issued during a regular traffic stop that was not associated with an FMCSA roadside inspection.
PSP should therefore not be considered a replacement for an MVR or a complete U.S. court record search.
π Mexico Driving Record vs. PSP
π²π½ Mexico Driving Record
Provides the driver's available:
- License information
- License status
- Driving-record information available through the Mexico record source
πΊπΈ FMCSA PSP
Provides additional U.S. commercial safety history, including:
- Roadside inspections
- Inspection violations
- Out-of-service violations
- FMCSA-reportable crashes
π‘ These reports contain different information and complement each other.
β Which Reports Should I Order?
For pre-employment screening of a Mexico Federal CDL driver who has operated commercial vehicles in the United States, MVRcheck recommends considering:
π²π½ Mexico Federal CDL Driving Record
β πΊπΈ FMCSA PSP β U.S. Commercial Safety History
Together, these reports can provide a more complete picture of the driver's available:
- Licensing history
- U.S. roadside inspection history
- Commercial safety violations
- FMCSA-reportable crash history
π Important PSP Authorization Requirement
PSP reports are intended for pre-employment screening of commercial drivers.
The employer must obtain the required driver authorization before a PSP report can be requested.
β οΈ PSP should not be represented as a complete search of all U.S. traffic citations or convictions.
